SHIPPING POLICY

PURCHASE OF PRODUCTS


In order to purchase the products, the User must pay for the selected products, taxes and shipping costs through the payment service providers that COLDAY makes available to the User on the Website. The User may only purchase products through the Website to be delivered to an address within the territory of the United States.


Once the purchase has been made by the User, by implicitly accepting the Terms and Conditions of Use, COLDAYUSA LLC will send an e-mail to the User informing him/her of the details of the purchase made.


PAYMENT


The payment of the products purchased on the Site may be made by any of the payment methods offered by the Site, being these, among others: credit card, debit card. The list of payment methods offered may be subject to change at any time without prior notice to Users.


Payment by credit card or any other online payment method must be made on the Site.


The order number assigned when making the transaction on the Site does not imply acceptance of the transaction. In case of any problem with your order, the User will be notified by email or telephone.


COLDAYUSA LLC will send the purchase confirmation via email. Only after payment confirmation will the products be released for delivery to the delivery address indicated by the User.


COLDAYUSA LLC reserves the right to request official documents to its customers, as a means of validation to the process of purchasing products through the Site.


In case of ignorance by the corresponding banking institution to the charges made by the User through credit card and arising from transactions made on the Site, COLDAYUSA LLC reserves the right to initiate appropriate legal action and to establish criminal or civil liability as appropriate or any other nature, as well as to perform all those internal actions that may range from charging again the credit card of the User to the definitive cancellation of the User on the Site, for which no prior authorization from the User will be required. 



ORDER OF ACCEPTANCE AND PRICES


All the prices of the products that are indicated through the Website include the taxes that may apply to them. However, these prices do not include the expenses corresponding to the shipment of the products. This will be calculated automatically in accordance with the information inputted and included in the final quotation.  


The User must consider that there are cases in which an order can not be processed for various reasons. In that sense, COLDAYUSA LLC reserves the right to refuse or cancel any order for any reason, at any time. Furthermore, it should be clear that the User may be asked for additional information, even before accepting the order.


COLDAYUSA LLC will provide the most accurate pricing information for Users, however, certain errors may still occur, such as cases where the price of an item is not displayed correctly on the Website. As such, the Company reserves the right to refuse or cancel any order. In the event that the price of an item is incorrect, COLDAYUSA LLCmay at its discretion contact the User for instructions or cancel the order and notify the User of such cancellation. It should be noted that COLDAYUSA LLC shall have the right to cancel such orders, whether or not the order has been confirmed and paid for. 


PRODUCT AVAILABILITY


All products offered on the Site are subject to stock and availability, so the delivery time may vary with prior notice from us.



SHIPPING COSTS AND DELIVERY OF PRODUCTS


COLDAYUSA LLC will send the products purchased by the User to the address specified by the User for this purpose as long as the address is within the area of coverage communicated by COLDAYUSA LLC.


The delivery time begins upon confirmation of payment by the bank, online payment platform, or COLDAYUSA LLC's credit department.


The products will be shipped and delivered to the User by third parties (hereinafter "Carriers"). By virtue of the foregoing, the User agrees to submit for the shipment and delivery of the products to the delivery policies of the Carriers.


The term described in the Site is an estimate. Thus, it is possible that such a term may change due to logistical reasons and force majeure. In the event of any fortuitous event or force majeure that may delay the delivery of the products purchased on the Site, COLDAY shall at all times be exempt from any liability.


In the event that the User has not received the products within the period declared by COLDAYUSA LLC, he/she should contact the Company through the customer service center at the email address: sales@coldayusa.com


The cost of freight will be added to the value of the goods purchased and will be calculated and informed to the User prior to the confirmation of the purchase. The cost of freight may depend on factors such as the total weight of the goods, distance and type of delivery, and may be modified by COLDAYUSA LLC at any time without prior authorization from the User.


COLDAYUSA LLC suggests that the User verifies the integrity and quality of the products received at the time of delivery. If the User is not satisfied with the products, he/she is requested not to receive the delivery from the carrier and to immediately contact COLDAYUSA LLC's customer service center.


CANCELLATION OF THE PURCHASE OF PRODUCTS


The User may cancel the purchase of Products made through the Website, provided that the Products purchased have not left COLDAYUSA LLC's offices. In the event that the Products have already been shipped by COLDAYUSA LLC * the User may not cancel the purchase made, and will have to follow the procedure presented in the "Returns" section of these Terms and Conditions. The User may check the status of the purchase made through the My Orders section of the User's Account or by contacting COLDAYUSA LLC's customer service center at the email address: sales@coldayusa.com.  In case of cancellation of the purchase made by the User, the amount paid by the User will be refunded in accordance with the "Refunds" section of these Terms and Conditions.


RETURNS


Return Conditions: 


The User may return products purchased through the Website, provided that:


Request the return within 5 calendar days from the date of delivery OR, exclusively for cases

of defective products, within the warranty period specified for the products purchased.

The product(s) are in the same condition in which they were delivered to the User and found, as far as possible, with the original packaging and labeling, or alternatively in some similar format that guarantees the return in perfect condition. 


Return Process: 


The process for returning the Products shall be as follows:


The User must contact COLDAYUSA LLC's customer service center within the established term requesting the return of the products and providing, name and surname, order number, names of products to be returned, address where the products will be picked up. In the event that the return is due to the fact that the product(s) is/are defective or is/are a different product than the one purchased through the Website, the User must also express such circumstance.


Once the Return Request has been approved, COLDAYUSA LLC will send the User a guide for shipment through the corresponding Transport Company, as well as schedule the date on which the Transport Company will pick up the products from the address provided by the User.


The cost and method of return is the customer’s financial responsibility, unless the returned items were shipped in error.


  1. A call tag will be issued to pick up the undesired return items. The customer is financially responsible for each service request. The cost of this service will be deducted from the final credit.
    b. If items were shipped in error, COLDAYUSA LLC will be financially responsible for the cost of the initial call tag.

If call tag service is requested, please remember to have your package(s) ready for pick-up. Additional call tag requests may be charged back to the customer.

It is the customer’s responsibility to ensure that the returned item(s) are packaged securely to eliminate/minimize any possible damage in transit.

Upon receipt of returned product, Colday will inspect it to determine if the product has been tampered with. Once it has passed inspection, we will issue the appropriate credit or refund.


REFUNDS


If the payment was made by debit or credit card, the refund will be made through a chargeback on the same card that was used. If the payment was made by other means, the refund will be made through a bank transfer to the User's account.


The User will be reimbursed the cost of the returned products plus the cost of freight paid by the User for them.


COLDAYUSA LLC is not and will not be responsible for the expenses caused by those returns that are produced without respecting the steps established in the procedure presented in the section "Returns".


Time limit for refunds in case of cancellation can be up to three business weeks.

CREDITS AND PROMOTIONS


COLDAYUSA LLC will inform Users subscribed to the newsletter, by e-mail, of all future promotions and opportunities, with the respective dates and conditions.


Promotions will have specific terms and conditions, and Users interested in participating will be responsible for reading and understanding these terms and conditions.


COLDAYUSA LLC coupons are not cumulative with other coupons from the same store.


Credits generated by COLDAY's promotional actions (coupons, etc.) may be exchanged exclusively for physical products sold on the Website www.colday.com  Credits may not be exchanged for other credits.
